ROOMMATE AGREEMENT

This Roommate Agreement ("Agreement") is entered into as of 1 September 2026 between Jordan Reyes, Sam Whitfield, and Priya Anand (each a "Roommate"), who share the residence at Apt 4B, 218 Maple Street, Austin, TX (the "Property").

1. Parties & Property. The Roommates jointly occupy the Property under a lease with the landlord dated separately. This Agreement governs the Roommates' obligations to one another.

2. Term. This Agreement runs from 1 September 2026 through 31 August 2027, matching the lease term, and continues month-to-month thereafter while the Roommates share the Property.

3. Rent & Deposit. Total monthly rent is $2,400, due to the landlord by the 1st of each month. Shares: Jordan Reyes $900 (master bedroom); Sam Whitfield $750; Priya Anand $750. Each Roommate contributed $800 toward the $2,400 security deposit held by the landlord.

4. Utilities & Shared Expenses. Electricity, water, internet, and gas are split equally three ways, settled by the 5th of each month. Household supplies are tracked in a shared app and settled monthly. Shared purchases over $100 require agreement from all Roommates before purchase.

5. House Rules. Quiet hours are 10:00 PM to 8:00 AM Sunday through Thursday, and from midnight on weekends. No smoking anywhere inside the Property. Priya's cat, Milo, is approved; no additional pets without unanimous agreement and landlord approval.

6. Guests. Guests are welcome. Overnight guests may stay up to three consecutive nights; more than five overnight stays in a month requires the other Roommates' consent.

7. Cleaning & Shared Spaces. Kitchen and bathroom cleaning rotates weekly per the posted chore chart. Each Roommate washes their own dishes within 24 hours and keeps shared spaces free of personal items.

8. Moving Out & Replacement. A Roommate leaving before the lease ends gives 60 days' written notice. The incoming replacement reimburses the departing Roommate's $800 deposit share directly; the deposit itself remains with the landlord until the lease ends. Replacements must be approved unanimously by the remaining Roommates and accepted by the landlord.

9. Disputes. The Roommates will first attempt to resolve any disagreement through a good-faith household discussion, with unresolved issues raised in writing, before pursuing any other remedy.

10. Relationship to the Lease. This Agreement is solely between the Roommates. It supplements, and does not modify or override, the lease, and it does not bind the landlord. Each Roommate's obligations to the landlord under the lease remain unchanged.

11. Entire Agreement. This is the entire agreement between the Roommates on these subjects. Amendments must be in writing and signed by all Roommates.

Is a roommate agreement legally binding?
A signed roommate agreement is generally enforceable between the roommates as a contract, especially its money terms — rent shares, deposit contributions, and bill splits. Courts take clear, written financial commitments seriously; lifestyle clauses like chore charts are harder to enforce but still valuable because they set expectations in writing. Does a roommate agreement override the lease?
No. The lease with your landlord always controls, and a roommate agreement cannot modify it. A roommate agreement is a separate, private contract between roommates that fills in what the lease leaves out: who pays what share, how chores and guests work, and what happens when someone moves out. What happens if a roommate stops paying their share?
If you are jointly on the lease, the landlord can usually pursue any or all tenants for the full rent regardless of your private split — that is exactly why a written agreement matters. It documents each person's agreed share, so a roommate who covers a defaulting roommate's portion has a clear written basis to recover it from them, including in small claims court if it comes to that.
Should the landlord sign the roommate agreement?
No. A roommate agreement is between the roommates only — the landlord is not a party to it and is not bound by it. Your relationship with the landlord is governed by the lease. If you need the landlord's approval for something (like adding a replacement roommate to the lease), handle that separately with the landlord in writing.
When should we sign a roommate agreement?
Ideally before or right when you move in together, while everyone agrees and nothing is contentious. It is much easier to decide how deposits, guests, and move-outs work in advance than to negotiate them mid-dispute. Existing households can sign one at any time — many do after their first disagreement about bills or cleaning.
